PREAMBLE

The company, SR SPORTS (RCS Chambéry 789 199 452, registered office: 695 avenue Paul-Louis Merlin – 73800 Montmélian, France), owner of the SKI REPUBLIC brand, provides on this website for bookings, rental of ski equipment and associated gear (boots, poles and helmets).

Booking ski or snowboard equipment via our website implies acceptance of the general terms and conditions specified below.

These terms and conditions govern the rental of ski or snowboard equipment by SKI REPUBLIC to the Customer via the Internet. Customers wishing to rent equipment through this website must first register to become Customers.

The Client will definitively validate their rental by viewing a summary displayed on the screen, by "clicking" to signify their commitment, knowledge and acceptance of the general and specific conditions below.

CLIENT Definition

"Customer" is defined as any person renting equipment on the website www.ski-republic.com/ and making payment for that rental. A Customer may rent equipment for several people, but will be solely responsible to SKI REPUBLIC.

Definition SKI REPUBLIC

SKI REPUBLIC is defined as a network of stores owned by or affiliated with the company SR SPORTS, as well as the website www.ski-republic.com/. This may be referred to hereafter as the "Website".

Definition of RENTAL STORE(S)

Shop(s) Rental(s) is defined as the Shops that are members of the SKI REPUBLIC network, the list of which appears on the Website.

 

Article 1: Equipment Rental Booking

The Client declares that they are 18 years old and have the legal capacity to contract on the website and to comply with these General Terms and Conditions, or that they have parental authorization allowing them to make a reservation on the website.

The categories of equipment, services and applicable rates are described on the website, it being specified that only categories of equipment are offered and in no case a specific model.

The general characteristics of each of the categories offered are listed on the Website, along with at least one example of equipment corresponding to each category. The Customer then selects and reserves a category of equipment. The equipment examples are provided for illustrative purposes only and are not contractually binding.

Making a reservation involves several steps on the website:

  • The Client chooses a ski resort and a rental period (1st day of skiing – last day of skiing).
  • The customer chooses a store. The customer chooses their ski equipment / services (optional).
  • The customer creates an account or logs in.
  • The customer pays for their reservation.
  • The Customer then receives an order confirmation email from SKI REPUBLIC shortly.

The order confirmation email signifies acceptance by SKI REPUBLIC of the Client's reservation.

 

Article 2: Prices and payment terms

2.1. Rental Rates

Rental prices are indicated in Euros including VAT and depend on the category of equipment rented by the Customer, the chosen Rental Store, the rental period and the date of booking.

SKI REPUBLIC reserves the right to modify its categories and applicable rates during the season. The applicable price is the one displayed on the website at the time of booking. This price is only contractually binding after booking confirmation and deposit payment.

SR SPORT reminds customers that the pricing and discounts displayed on the SKI REPUBLIC website are valid exclusively for bookings made on www.ski-republic.com and cannot be applied in-store. Therefore, any equipment rental made directly at the rental shop (without a prior online reservation) will be charged at the shop's standard rate.

Baskets saved on the SKI REPUBLIC website are valid for 14 days provided you have created your account, so the prices concerned will remain unchanged until the end of this period.

The promotional codes provided via newsletter or online are valid for a limited time and only at participating stores. Please note that some stores are not participating in the promotion: Jordan's Sports, Technique Extreme, Magnin Sport, l'Atelier 1550, l'Atelier 1650, l'Atelier Bohème, Les Alpages, Chaud Sport 1800, Chaud Sport 1600, Maison Clataud Sport Sestrières, Le Barachin, Maison Clataud Sport, Maison Clataud Sport - Sportinia and Maison Clataud Sport 2, Montagne Sport.

Discount codes cannot be combined; they must be entered at the shopping cart stage when booking on www.ski-republic.com.

As part of formal partnership agreements, a membership card will be required in the store to justify membership in the signatory organization.

SKI REPUBLIC will charge the user a booking fee in addition to the rental price. This booking fee amounts to €1.50 per piece of equipment.

2.2. Payment terms

When booking on the website, the Customer selects the Rental Shop from which they wish to rent their equipment. The Customer then selects the desired equipment category.

After selecting the equipment, the Client will be asked to confirm their reservation. The Client has the option of paying either 100% of the reservation amount or a 30% deposit. Only the payment of the deposit or the full amount of the reservation will register the reservation on the website.

Confirmation of the rental constitutes authorization to pay the price, including all taxes (TTC), of the rental.

Once the reservation has been concluded after SR SPORTS has received the agreement from the central banking network regarding the payment of all or part of the reservation and the Client has received an email confirming that the reservation has been taken into account, these two conditions being cumulative, the Rental Store undertakes to rent to the Client the equipment reserved according to the terms and conditions set out in the reservation and these General Terms and Conditions, the Client undertakes to take the said equipment reserved according to the same terms and conditions.

2.3. Payment methods

The Customer can pay for their reservation online on the Site in several ways.

  • Payment by bank card:

Payments must be made using a bank card: cards bearing the CB logo, cards bearing the "Visa" or "Mastercard" brand accepted in France, as well as cards issued within the framework of international networks approved by the GIE Cartes Bancaires.

To ensure your purchases are secure, SKI REPUBLIC has chosen Crédit Agricole, provider of the Up2pay payment solution. Up2pay makes your online transactions easier and more secure. Every transaction is encrypted, and no banking information is stored on our site. The payment platform is fully secured thanks to 3D Secure, the new standard for validating your bank card number, expiry date, and security code.

The central bank card network's approval makes the order validated by the Customer on the website effective. In the event of a refusal by the central bank card network, SR SPORTS reserves the right to cancel the reservation.

  • Payment in 2, 3 and 4 installments with ALMA:

Payment in installments/deferred payment is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

Only purchases over €100 are eligible for payment with Alma.

When paying in installments with Alma, the Customer pays fees in the following cases:

  •  
    • P2X: 0.82% per transaction
    • P3X: 1.66% per transaction
    • P4X: 2.47% per transaction

Alma is a remote payment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the civil code.

Any termination of the General Terms and Conditions of Sale which bind the Seller and the customer, entails the termination of the General Terms and Conditions of Use between Alma and the customer.

 

Article 3: Exclusive Offers and Paid Services

3.1. Exclusive Offers

4-pack offer: Order 4 or more packs and automatically receive an additional 5% discount on your entire order. Please note that this offer cannot be combined with the Family or Group offers.

Family Offer: Book a Child's package (Kid Initiation, Junior Evolution, Junior Performance, or Junior Sensation) with at least one Adult package and receive an additional 5% discount. This offer cannot be combined with the 4-Pack offer or the Group offer.

Group Offer: Book 8 or more packs and automatically receive an additional 10% discount on your entire order. Please note that this offer cannot be combined with the Family offer or the 4-pack offer.

6+1 Offer: For every 6 days of rental, the 7th day is free. It couldn't be simpler: your price will be automatically adjusted when you book. This offer can be combined with all other current promotions.

3.2. Paid Services

Each service is subject to a fee and can be added to your online shopping cart at the prices in effect at that time. Each service is valid only in stores that offer the service in question.

Each of the services offered by SKI REPUBLIC will be provided within the Store's opening hours.

In case of cancellation before stay, all services will be refunded.

In case of cancellation on site or during stay, no service will be refunded, whether unused or partially used.

  • Storage : Drop off your equipment at the store at the end of the day and pick it up the next day.
  • Ski storage : Leave your equipment in lockers at the end of the day and pick it up the next day.
  • Flexski : Flexibility for your rental: modification, deletion and addition of packages, etc.
  • Multi-slide : Try several types of slides during your stay
  • Maintenance/Repair : Have your ski or snowboard equipment serviced when you arrive at the resort.
  • Fastpass : You have priority in retrieving your equipment.

Article 4: Modification and Cancellation of the Reservation.

4.1. Reservation Modification

Any change related to the reservation date, category, size and/or quantity of Reserved Equipment or paid services offered will be made in accordance with the conditions defined below.

If the change is made no more than 24 hours before the first day of skiing, the difference between the two bookings will be refunded or supplemented by a minimum of one euro (€1). Please note that regardless of the change, the prices in effect at the time of the change will replace the prices of the original booking. If the change concerns only one package, only that package will be affected by the price change; if it concerns the entire booking (change of date or store), all prices will be updated.

Three situations may arise.

  • If the amount of the new Reservation is greater than the Initial Reservation , the additional amount of a minimum of one euro (€1) must be paid directly in store.
  • If the amount of the new reservation is less than the Initial Reservation and there is no balance to pay in store , the difference between the new reservation and the Initial Reservation will be refunded within 30 days by crediting the bank card used for the online reservation.
  • If the amount of the new reservation is less than the Initial Reservation and there is a balance to be paid in store , the difference between the new reservation and the Initial Reservation will be taken into account when paying the balance of the rental price in store.

Regardless of the situation, once the changes are saved, the Customer receives a new order confirmation email with the new modified information.

4.2. Right of withdrawal

In accordance with applicable legal provisions, the Client has a right of withdrawal, without having to justify a reason, within 14 calendar days from the date the Client receives the booking confirmation email.

To exercise their right of withdrawal, the Customer must notify their decision by means of an unambiguous statement directly to SKI REPUBLIC by email via the online contact form or via their online customer area.

SKI REPUBLIC will reimburse the Customer for the total amount including tax paid online, when booking on the Site, within a maximum period of 30 days by crediting the bank account used when booking online.

SKI REPUBLIC refuses any refund to any payment method other than the one used for the booking.

After this 14-day period, in all cases, the Client will not be entitled to any full refund of the sums paid.

However, the Customer's right of withdrawal is excluded in the following case:

For any booking made less than 14 days before the scheduled equipment collection date, the cancellation period ends the day before the first day of rental. Any cancellation request must therefore be sent no later than 24 hours before the scheduled equipment collection date.

4.3. Cancellation after the withdrawal period and before the scheduled collection date of the rental

SKI REPUBLIC offers its customers free cancellation of their reservation without loss of deposit up to 24 hours before the first day of rental.

For any cancellation request made after the expiry of the withdrawal period and before the scheduled collection date of the reserved equipment, SKI REPUBLIC retains the processing fees as well as the insurance fees as compensation.

SKI REPUBLIC will reimburse the Customer for the total amount including tax paid online, when booking on the Site, within a maximum period of 30 days by crediting the bank account used when booking online.

SKI REPUBLIC refuses any refund to any payment method other than the one used for the booking.

4.4. Cancellation after the scheduled pick-up date of the rental

No refunds will be issued after the date of collection of the equipment, except in the following cases of force majeure:

  • Accident or illness of the client

In the event of injury or illness to the Client during their stay, the Client may return the equipment in question early. Upon presentation of a medical certificate and a refund request completed by the Rental Shop, SKI REPUBLIC will reimburse the Client pro rata for the days actually used (any equipment returned after 10:00 AM will be considered rented for the day).

  • Death of a direct relative

In the event of the death of a direct relative during their stay, the Client may return the relevant equipment early. SKI REPUBLIC will reimburse the directly affected person(s) upon presentation of supporting documentation and a completed reimbursement request form from the Rental Shop. The reimbursement amount will be calculated pro rata based on the number of days actually skied (any equipment returned after 10:00 AM will be considered rented for the day).

In the event of a COMPLETE closure of the ski area normally accessible from the Rental Shop, and only in this case, the equipment may be returned and the corresponding rental days deducted, provided the equipment is returned to the shop before 10:00 AM for the days in question. Upon presentation of proof from the ski lifts and a refund request completed by the Rental Shop, SKI REPUBLIC will reimburse the Customer pro rata for the days actually used.

However, in the event of a lack of snow, SKI REPUBLIC will not refund unused rental days if the ski lifts are not completely closed.

In all the above cases, the amount refunded to the Client can never exceed the following formula:

Amount refunded = Total equipment rental price – Price of rental days actually used* *Reservation fees and Carré+ insurance will be deducted

All refund requests must be submitted directly to Customer Service via the online contact form.

The refund will be processed within 30 days, and there are three possible ways to do so:

  • The refund amount is less than the amount paid online : refund by credit to the bank card used for online payment.
  • The refund amount is greater than the amount paid online : refund in two parts, firstly a refund of the deposit by credit to the bank card then a refund of the remainder by bank transfer, the latter will therefore have to provide his bank details.
  • No amount was paid online : refund by transfer to the Client's bank account, the Client will therefore have to provide their bank details.

 

Article 5: Guarantees and Insurance

Each guarantee or insurance is subject to a fee; it can be added at the online shopping cart stage on our website, at the rates in effect at that time.

In case of cancellation before stay, all guarantees or insurances will be refunded, except for Carré + insurance, according to the conditions described in article 4.

In case of cancellation on site or during stay, no guarantee or insurance will be refunded, whether unused or partially used.

5.1. Breakage and Theft Guarantee

When booking, the customer has the option to insure the rented equipment against damage (total or partial damage to the ski equipment), destruction or disappearance (total or partial theft) in the following cases:

  • In case of breakage during their use by the renters
  • In the event of THEFT occurring outside the subscriber's business premises, the guarantee can be purchased at the time of booking on the website or in store.

In all cases, the following conditions apply:

  • The Guarantee does not cover the forgetting, loss or replacement of ski equipment during the stay.
  • The Guarantee is nominative and is only applicable up to a limit of one claim per stay.
  • On the Internet, it can only be purchased before the rental payment is made, and cannot be added afterwards.
  • In store it can only be purchased at the time of collection of the equipment, and cannot be added afterwards.
  • The deposit is non-refundable under any circumstances.

By subscribing to the Breakage and Theft Guarantee, the Customer will be able to obtain a preferential rate for the payment of the deductible in the event of breakage or theft of their equipment.

The cost of the warranty is determined based on the category of equipment reserved by the customer, according to the rates below:

Guaranteed Franchise

The Customer who has subscribed to the Breakage and Theft Guarantee returns a broken ski from the Performance range to the Rental Shop.

The ski in question was purchased four years ago by SKI REPUBLIC, so it is 5 years old (the current year and the four previous ones).

According to the table, the price for a Performance pack is €280. Calculating the depreciation years, the amount to pay will be €124.24. [280 x 0.85 = 238 x 0.85 = 202.30 x 0.85 = 171.96 x 0.85 = 146.16 x 0.85 = €124.24].

Client's obligations in the event of a claim:

  • In the event of theft of ski equipment , the customer must provide the rental shop with the original police report for theft, along with the identity document of the person whose equipment was stolen and, if different, the identity document of the person who made the reservation.
  • In case of damage to ski equipment , the customer will return the damaged equipment to the Rental Shop; the equipment must be identifiable and complete.

5.2. Snow Guarantee

If less than 50% of the ski lifts are open during the rental period, SKI REPUBLIC customers who have purchased the Snow Guarantee on our website may request a refund for the days not skied.

The opening rate of the ski area, normally accessible from the equipment rental location, is determined by the Tourist Office or the Ski Lift Operator. Each customer who has purchased the Snow Guarantee must provide proof of the opening rate to be eligible for a refund for unused days.

Refund valid only on ski and snowboard equipment rental.

5.3. Carré + Insurance

The Carré + insurance is a more comprehensive option than the breakage and theft guarantee, which only protects the equipment we provide to you.

The Carré + insurance protects you, your family, and your belongings. It covers:

  • Search and rescue costs
  • Initial transport costs
  • Medical expenses
  • Home repatriation assistance (home is defined as the insured's principal and usual place of residence on the date of subscription, located in one of the countries of the European Union or in Switzerland)
  • Reimbursement of ski lift passes and ski lessons
  • Insurance against theft and damage to rented equipment

Article 6: Provision and return of rented equipment

Please note that any booking made less than 48 hours before the start of the stay does not guarantee the availability of the chosen facilities.

6.1. Provision and use of rented equipment

The Client will receive an email confirming the rental. Only this email, containing a summary of the rental conditions, constitutes confirmation and definitively validates the transaction.

If it turns out that the Client cannot show up on the first day of the rental as confirmed, he must inform SKI REPUBLIC as soon as possible, by sending a message via the online contact form.

The rental agreement is in effect for the duration of the rental.

The rental takes effect when the Customer takes possession of the equipment in the chosen Station Store, for the period indicated in the rental agreement.

Rental shops are only obligated to hold equipment reserved by the customer via the website until 10:00 AM the day after the first day of rental indicated in the booking confirmation email. After this time, the equipment will be made available for rent again by the rental shop, without the customer being entitled to any compensation or reimbursement. In such a case, the deposit remains the property of SKI REPUBLIC.

The reserved equipment must be collected from the rental shop where the reservation was made, as indicated in the reservation confirmation email. The reserved equipment will be made available only to the person who made the reservation.

The reserved equipment will be released to the customer upon presentation of the confirmation email. If this email is unavailable, proof of payment and the order reference code will be required. The remaining balance due in-store will be paid upon collection of the equipment, in accordance with the store's general rental terms and conditions. Failure to comply may result in the rental being refused by the rental store, without any refund of the deposit.

The rented equipment and materials are for the Client's sole use, with no possibility of subletting or lending, even free of charge. The Client assumes full responsibility for them from the moment they take possession.

The Client is solely responsible for assessing their ability to use the rented equipment, as SKI REPUBLIC relies exclusively on the Client's declarations. However, any reservations regarding the condition of the equipment must be reported by the Client to the Rental Shop upon collection and noted on the rental agreement upon signature. Failure to do so will invalidate any subsequent claims.

SR SPORTS, which handles reservations on the website on behalf of the rental shops, cannot be held responsible for any failure in the provision of the reserved equipment by the rental shop in question. However, if the rental shop is unable to provide the customer with the reserved equipment, the rental shop must make every effort to provide the customer with equipment of equal or superior quality at the same rental price.

The Customer may collect their equipment from the Store, the day before their first day of skiing, from 4:00 p.m., current opening hours, subject to availability in the Store of origin of the order.

6.2. Terms for returning rented equipment and customer responsibility

The rental agreement automatically terminates on the date specified in the rental agreement.

The return of the equipment is mandatory upon expiry of the rental period under the penalties provided for in Article 314-1 of the Penal Code, without the need to send a formal notice by registered letter with acknowledgment of receipt and without the Client being able to invoke any impediment.

The equipment must be returned to the store where it was picked up.

Any equipment returned after 10 a.m. on the day following the last day of rental will result in the Client being charged and paid for additional days of rental, at the public rate displayed in the Store.

If the Client is unable to return the equipment for any reason whatsoever, he will be charged and will have to pay SKI REPUBLIC any late fees in addition to the INVOICE and the rental price already paid.

On the last day of the rental, as stipulated in the rental agreement signed by the Parties, the Client must return the equipment, in the same condition as when it was collected, to the rental shop at the station. All equipment is numbered and marked, and must be returned with the same number and marking.

For safety reasons, the Customer agrees to report to the Station Shop any impacts suffered by the helmet(s) rented by him/her.

Any excessive damage deemed to have been caused by negligence will result in the Client being liable for replacement or repair costs. The maximum replacement/repair cost will be the cost of replacing the equipment with a "like new" item. This cost will be added to the rental price already paid (as stipulated in Article 5).

The Customer agrees that, in the event that a pair of skis or a snowboard is returned damaged but cannot be safely put back into rental, this equipment will be considered "unrepairable" and the amount to be paid will be the price of new equipment, purchased for replacement.

The Customer also agrees that this assessment will be made by the Store Manager at the location where the equipment was rented. The Customer expressly agrees that SKI REPUBLIC may, in the event of late payment or non-payment of the RETENTION/INVOICE, debit their bank account for any amount due, using the credit card number and expiry date provided by the Customer.

 

Article 7: Damage or Theft - Equipment not returned or returned damaged

SKI REPUBLIC may retain the details of the credit card used by the Client for payment of the rental, in order to allow any compensation following the breakage or theft of one or more rented items, and/or to cover cases in which the Client does not return all the winter sports equipment he has rented.

SKI REPUBLIC may also pre-authorize, at the time of payment, an amount equivalent to the amount specified in Article 5, for the rented winter sports equipment. This amount will only be charged to the credit card in the event of loss, theft, or non-return of the rented equipment. This authorization will no longer be valid after the equipment has been returned in good condition.

The Rental Store may also require a security deposit to cover the risks of damage, theft, or loss of the Rented Equipment. The amount and terms of the security deposit are determined by the Rental Store. This security deposit will be returned to the Customer by the Rental Store upon return of the rented equipment if no damage or discrepancies are found.

In the event of breakage or failure to return the equipment, the customer will be charged the flat rate described in article 5.

 

Article 8: Complaints

Any complaints arising during the execution of the rental contract must be reported as soon as possible to the manager of the Station Shop at the place of stay so that a solution can be sought as soon as possible.

Complaints that could not be dealt with on site or that have not been resolved must be submitted within 31 days of the end of the booking via the contact section of the SKI REPUBLIC website.

Any claim received more than 31 days after the end date of the Client's reservation will be inadmissible and will not give rise to any compensation or redress whatsoever.

If supporting documents are required, they must be received within a maximum of 31 days from the date of the request by customer service. After this period, the customer's claim will be inadmissible and will not give rise to any compensation or redress whatsoever.

 

Article 9: Protection of your Personal Data

Concerned about respecting privacy, the rights of its customers and the information they provide, SR SPORTS complies with current legislation regarding privacy protection.

This license does not permit any other use, including commercial use, of the Site or its content (products, brands, descriptions, prices, data, software, sound clips, graphics, images, photographs, etc.).

All elements of this Site, whether audio or visual, including the technology used, remain the exclusive property of the Company and are protected by copyright.copyright, trademarks or patents.

 

Article 12: Trade Mediation

In accordance with current legislation, article L-612-1 of the Consumer Code, the Rental Stores of the SKI REPUBLIC network offer their customers, for any dispute not resolved in store or by customer service, relating to the sale of products or the provision of services, the free use of the CM2C mediation service to which we belong electronically https://www.cm2c.net/.

 

Article 13: Applicable Law and Jurisdiction

This contract is governed exclusively by French law.

In the event of any dispute relating to this contract or for any litigation, the competent court shall be that of the registered office of the company SR SPORTS (the court of Chambéry) to which the parties attribute exclusive jurisdiction.
